1. Who we are

This Privacy Policy describes how PKNT Enterprises, LLC, a Massachusetts limited liability company doing business as Cadence Advisers ("Cadence," "we," "us," or "our"), collects, uses, and shares information about you when you visit cadenceadvisers.com (the "Site") or use our services (collectively, the "Services").

Our principal address is 15 Cattail Lane, Sharon, MA 02067.

2. What this policy covers

This policy covers personal information we collect through the Site and the Services. It does not cover information practices of third parties we don't own or control, including the third-party services described in Sections 7 and 8.

If you do not agree with this policy, please do not use the Site or the Services.


3. Information we collect

We collect information you provide directly to us, information we collect automatically, and information from third parties that you direct to share with us.

3.1 Information you provide

When you interact with the Site or the Services, you may provide us with:

  • Contact and identity information: name, email address, phone number (optional), company name, industry
  • Assessment responses: answers to questions in our Tempo assessment, including free-text responses about your business, operations, goals, and challenges
  • Engagement content: information you share during consulting engagements, which may include meeting transcripts, business documents, written notes, and other materials you provide

3.2 Information we collect automatically

When you visit the Site, we automatically collect:

  • Technical information: IP address, browser type and version, operating system, device type, referring URL, and pages visited
  • Cookies: strictly-necessary cookies used for authentication and security. We do not use cookies for analytics, advertising, or behavioral tracking. See Section 8 for details.

3.3 Information from third-party services you authorize

If you choose to record or share content from third-party tools (for example, providing meeting recordings or transcripts to Cadence), we receive the information contained in those materials. We only access information you affirmatively share with us.


4. How we use your information

We use the information we collect to:

  • Provide and operate the Services
  • Generate assessments, discovery analyses, and proposals based on the content you share
  • Communicate with you about your engagement, deliverables, and operational matters
  • Send you transactional emails (such as assessment results, notifications about your engagement page, and account-related messages)
  • Improve our Services and develop new features
  • Maintain the security of the Site and the Services
  • Comply with legal obligations

We do not sell your personal information. We do not use your personal information for targeted advertising. We do not engage in behavioral tracking, retargeting, or cross-site profiling.


5. AI processing

Cadence uses artificial intelligence to generate assessments, discovery analyses, recommendations, and other deliverables. When you submit content through the Tempo assessment, share content during a discovery process, or otherwise provide information to Cadence, that content may be processed by AI systems we operate, which include third-party AI services described in Section 7.

We design our AI systems to treat your content as data to analyze, not as instructions to act on. We do not use your content to train AI models, and we do not share your content with AI providers for the purpose of training their models.


6. How we share your information

We share your information only as described below.

6.1 With service providers

We share information with the third-party service providers listed in Section 7. These providers process information on our behalf to operate the Services. They are contractually required to protect your information and use it only as we direct.

6.2 For legal reasons

We may share information when we believe disclosure is necessary to:

  • Comply with a legal obligation, court order, subpoena, or other legal process
  • Protect the rights, property, or safety of Cadence, our customers, or the public
  • Investigate or prevent fraud, security issues, or violations of our terms
  • Enforce our agreements

6.3 Business transfers

If Cadence is involved in a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

6.4 With your consent

We share information with third parties when you direct us to or consent to the sharing.


7. Third-party service providers and data flows

Cadence uses the following third parties to operate the Services. Each receives only the information necessary to perform its function.

Supabase Database hosting (Postgres on AWS, US region) All data we store about you and your engagement
Resend Transactional email delivery Email address, name, and message content for emails we send to you
Otter.ai Meeting transcription (when used during discovery engagements) Audio you share with us; transcripts derived from that audio
Google (Fonts) Web typography served from fonts.googleapis.com and fonts.gstatic.com Your IP address and browser metadata when font resources load on each page visit. Google Fonts does not set tracking cookies, but Google receives your IP as part of serving the font files.

We add or change service providers from time to time. We will update this policy when we do.

7.1 Outbound links

Some pages on the Site contain links to external services (for example, a scheduling link served by GoHighLevel and direction links served by Google Maps). When you click those links, you navigate away from the Site, and the destination service's privacy practices apply to your interaction there. We do not embed those services on the Site itself.


8. Cookies

Cadence uses only strictly-necessary cookies. These cookies are required for the Site and the Services to function, and you cannot opt out of them without losing the ability to use the Services.

All four cookies are set with HttpOnly and Secure flags. They contain no analytics, advertising, or tracking data.

8.2 Cookies set by third parties on the Site

When the public Tempo assessment widget loads, it includes Cloudflare Turnstile (an anti-abuse challenge tool) which sets cookies on challenges.cloudflare.com to track challenge state for security purposes. These are required for the widget's anti-abuse protection and are categorized by Cloudflare as strictly necessary.

In limited circumstances, Cloudflare's edge network may set a cf_clearance cookie following a managed security challenge.

8.3 What we do not do

We do not use cookies for analytics, advertising, retargeting, behavioral profiling, or any tracking beyond what is required to operate the Services. We do not use Google Analytics, Google Tag Manager, Facebook Pixel, LinkedIn Insight Tag, TikTok Pixel, or any similar tracking technology. We do not use any session replay, heatmap, or user-recording tool.


9. Your rights and choices

You have the following rights regarding your personal information:

9.1 Access

You can request a copy of the personal information we hold about you.

9.2 Deletion

You can request that we delete your personal information. We will honor deletion requests within 45 days, except where we are required to retain information by law or where information is necessary to protect our legal rights.

9.3 Correction

You can request that we correct inaccurate personal information about you.

9.4 Portability

You can request a copy of your personal information in a structured, commonly-used, machine-readable format.

9.5 Opt out of sale

We do not sell personal information. This right is automatically honored.

9.6 Non-discrimination

We will not discriminate against you for exercising any of these rights. We will not deny services, charge different prices, or provide a lower quality of service because you exercised a right.

To exercise any of these rights, email peter@cadenceadvisers.com with the request and a way for us to verify your identity. We will respond within 45 days.


10. Data retention

We retain your personal information for as long as needed to provide the Services and for the following additional periods:

  • Active engagements: information related to active engagements is retained for the duration of the engagement plus seven years for business records purposes
  • Inactive accounts: information from inactive accounts is retained for two years after the last interaction, then archived
  • Legal requirements: information we are required to retain by law is kept for the period required

You may request earlier deletion under Section 9.2.


11. Data security

We use reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, alteration, or disclosure. These include:

  • Encrypted data transmission (TLS) for all communications with the Site and the Services
  • Encrypted data at rest in our database provider
  • Role-based access controls limiting who within Cadence can access personal information
  • Authentication systems requiring valid credentials for access to personal information
  • Audit logging of sensitive operations
  • Regular security review and hardening of our systems

No security system is perfect. While we work to protect your information, we cannot guarantee absolute security.


12. Children's privacy

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us at peter@cadenceadvisers.com and we will delete it.


13. Geographic scope

The Services are intended for use by individuals and businesses in the United States. By using the Services, you consent to the collection, use, and storage of your information in the United States.

If you access the Services from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws.


14. California residents

If you are a California resident, the rights described in Section 9 apply to you under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). The categories of personal information described in Section 3 are the categories we have collected in the preceding 12 months. The purposes for which we use that information are described in Section 4. The third parties with whom we share information are described in Sections 6 and 7.

We do not sell or share personal information for cross-context behavioral advertising.


15. Changes to this policy

We may update this policy from time to time. When we do, we will revise the "Last updated" date at the top of the policy. If we make material changes, we will provide additional notice (such as by email or a prominent notice on the Site) before the changes take effect.

Your continued use of the Services after a change to this policy means you accept the updated policy.
